The Supreme Court has refused to review the decision of the First Circuit Court of Appeals to uphold New Hampshire’s prescribing data-mining law, IMS v. Ayotte. That decision, made last November, unanimously overturned an earlier district court ruling to strike down the prescriber data confidentiality law on constitutional grounds.

And a federal court in New York has denied an injunction of Vermont’s data mining ban sought by three health information organizations. The law, which prevents pharmacies from using or selling prescriber-identifiable data without a physician’s consent, goes into effect tomorrow, July 1.
